The following is issued on behalf of the Mandatory Provident Fund Authority:
An employer was fined $10,000 at the Kwun Tong Magistracy today (January 24), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance. Meanwhile, the Mandatory Provident Fund Authority (MPFA) today obtained four orders for payment of outstanding MPF contributions at about $410,000 against four employers in the District Court. The MPFA also pursued one claim in the Small Claims Tribunal for some $300 on behalf of three employees, who were owed MPF contributions by their employer.
Wison Printing Products Company Limited was charged for an offence under the ordinance in an ex-parte hearing. The defendant was convicted of three counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between October and December 2006. The defendant was fined $5,000 for the first summons and $2,500 each for the remaining two summonses, totalling $10,000.
The District Court today issued judgements against four employers, namely, Kin's Drainage Service Limited, Chuen Kow Auto Parts and Engineering Company Limited, Peace Line Engineering Limited and Chow Pik Ho formerly trading as Wing Keung Cleaning Service Company. The defendants were ordered to pay the MPFA the sums of $287,205.63, $92,586.02, $54,178.78 and $37,695, being mandatory contributions in arrears and surcharges payable to eight, three, two and one employees of the defendants.
At the tribunal's hearing today, the defendant, Ho Yuen Ching, did not dispute the amount claimed. The adjudicator ordered him to pay the MPFA the sum of $378.5, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the respective defendants to pay costs of $930.
