The following is issued on behalf of the Monetary Provident Fund Schemes Authority (MPFA):
A director and three employers were fined $44,000 at the Kwun Tong Magistracy today (October 2), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).
Director of Lee Sang Restaurant Group Limited (BR no.: 32694782) Li Mei Ling, was charged under section 7A(8) and section 44 of the ordinance and pleaded guilty to two counts of failing to make MPF contributions for two employees within the prescribed time for the contribution period of May 2006. The defendant was fined $2,000 for the first summons and $1,000 for the other summons, totalling $3,000.
Excel Dragon International Development Limited (BR no.:36828652) pleaded guilty to two counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between November and December, 2006. The defendant was fined $3,500 for the first summons and $1,500 for the other summons, totalling $5,000.
Best Lines Ltd (BR no.:21004792) pleaded guilty to 11 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April, 2005, and February, 2006. The defendant was fined $6,000 for the first summons and $1,200 each for the remaining summonses, totalling $18,000.
Hung Kwan Keung trading as Victoracct & Company (BR no.:21601924) pleaded guilty to 13 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April, 2006, and April, 2007. The defendant was fined $6,000 for the first summons and $1,000 each for the remaining summonses, totalling $18,000.
The MPFA today pursued one claim in the Small Claims Tribunal for some $2,000 on behalf of one employee, who was owed MPF contributions by the employer.
The defendant, Best Famous (HK) Limited trading as Ming Lau Seafood Restaurant, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA $2,099.10, being mandatory contributions in arrears and surcharges payable.
The amount awarded will be reimbursed to the employee's MPF account as soon as it is received by the MPFA. The tribunal further awarded $76 as costs in respect of the claim.
