Employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (August 30) obtained orders in the District Court for payment of outstanding MPF contributions at about $1,300,000 against seven employers. The MPFA also pursued four claims in the Small Claims Tribunal for some $50,000 on behalf of seven employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against Star Team Development Limited trading as Wall City, Kea Kwun (International) Fire Service Engineering Limited, New Jersey Knitting Factory Limited, Wing Wai Transportation Co. Ltd, Wing Kee Seafood Products Company Limited, COO International Limited and Sing Ngai Metal Works. The defendants were ordered to pay the MPFA $303,794.33, $280,207.97, $216,330.32, $170,065.50, $141,067.93, $139,850.61 and $69,965.88 respectively, being mandatory contributions in arrears and surcharges payable to 43, 7, 5, 15, 6, 18 and 3 employees of the respective defendants.

     The District Court also ordered Wing Wai Transportation Co. Ltd and Sing Ngai Metal Works each to pay the MPFA $5,000 as a financial penalty imposed by the MPFA for failure to make MPF contributions for their employees.

     At the tribunal's hearing, Plenty Profit Holdings Limited trading as New Style Restaurant, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $39,541.72, being mandatory contributions in arrears and surcharges payable.

     Three defendants, Bobsan Global Express Limited, Arta Printing (HK) Company Limited and Ho Shun Fat Alfons formerly trading as 228 King's House (formerly known as King's House Restaurant), did not appear and in their absence, the Adjudicator ordered them to pay the MPFA  $5,998.45, $3,999.77 and $567, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court further ordered the respective defendants to pay costs of $930 each for the District Court cases and the tribunal ordered each of the respective defendants to pay $306, $96, $90 and $70 for the tribunal cases.
