Employer fined for violation of safety rule

    New Asia Grocery Company Limited was fined $30,000 at Sha Tin Magistrates' Court today (August 17) for violating the Occupational Safety and Health Ordinance. The prosecution was launched by the Labour Department.

     The case involved a fatal accident on January 13 at a workplace in Sha Tin. A hand pushed stacker with some boxes of bottled beer toppled and struck  a worker who was loading boxes of bottled beer onto a lorry.

     According to Section 6(1), 6(2)(a) and 6(2)(c) of the ordinance, employers must provide and maintain a system of work that is safe and without risk to the health of the employee. They must also provide  information, instruction, training and supervision necessary to ensure the work health and safety of the employee.  Any employer who fails to do so is liable to a fine of $200,000 and imprisonment for six months.
