Six employers ordered to pay MPF non-payments

     The Mandatory Provident Fund Schemes Authority (MPFA) today (August 14) obtained two orders in the District Court for payment of outstanding MPF contributions at about $460,000 against two employers. The MPFA also pursued four claims in the Small Claims Tribunal for some $86,000 on behalf of 10 employees, who were owed MPF contributions by their employers.

     The District Court issued judgments against Choi Ming Restaurant (Holdings) Limited and Home Fortune International Enterprises Limited trading as Wong Shing Seafood Hot Pot Restaurant. The defendants were ordered to pay the MPFA $315,405.34 and $154,461.43 respectively, being mandatory contributions in arrears and surcharges payable to 45 and 58 employees of the respective defendants.

     At the tribunal's hearing, the defendants, Hin Sum Manpower Company Limited, Best Lines Limited, Kam Kin Engineering Services Limited and Chun Wui Tourist Bus Company Limited formerly known as C & M Travel Agency Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $38,339.85, $29203.03, $18,371.67 and $304.63, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the tribunal further ordered each of the respective defendants to pay costs of $930 each for the District Court cases and $170, $120, $176 and $166 for the tribunal cases.

     Hin Sum Manpower Company Limited previously pleaded guilty at Kwun Tong Magistracy to 30 counts of failing to make MPF contributions on time and was fined $84,500.
