The following is issued on behalf of the MPFA:
An employer has been fined $8,000 at the Kwun Tong Magistracy after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance.
King of Property Co Ltd (BR no.: 35559626) pleaded guilty to an offence under section 7(1) of the Ordinance - failing to enrol its employee in an MPF scheme.
Meanwhile, the MPFA today (August 13) and last Friday (August 10) pursued five claims in the Small Claims Tribunal for some $94,000 on behalf of 15 employees, who were owed MPF contributions by their employers.
At the tribunal¡¦s hearing today, Fortune-come Restaurant Ltd, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA $4,968.54, being mandatory contributions in arrears and surcharges payable.
At the tribunal¡¦s hearing last Friday, Hin Sum Manpower Company Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $44,192.30, being mandatory contributions in arrears and surcharges payable.
The other three defendants, Chan Wing Key Raymond trading as Hung Shing Hong, Strong Base Engineering Limited and Compact Building Materials Company Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $34,555.50, $6,161.78 and $4,166.97, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal further awarded $176, $170, $230, $80 and $116 as costs in respect of the claims.
Hin Sum Manpower Company Limited and Compact Building Materials Company Limited earlier pleaded guilty at Kwun Tong Magistracy to 30 and five counts respectively of failing to make MPF contributions on time and were fined $84,500 and $16,000 respectively.
