Twelve employers ordered to pay MPF non-payment

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (August 9) pursued 12 claims in the Small Claims Tribunal for some $240,000 on behalf of 43 employees, who were owed MPF contributions by their employers.

     At the hearing, two defendants, Ngai Yip Seafood Co Limited and Penon International Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $34,085 and $21,690.44 respectively, being mandatory contributions in arrears and surcharges payable.

     The other 10 defendants, Forest Spring Engineering Limited, Key Communications Technology (Asia) Limited, Cheng Kwok Ming trading as Jet On Transportation Company, The Firm Limited, Polylink (International) Cargo Service Limited, Chan Chun Pan formerly trading as Super Power Transportation Company, Gurkhas Construction Limited, Galaxy Smart Limited, Ngan Chin Fan and Yan Zhao Zhvan trading as Kam Fook Yuen Roast Rest and Fong Shiu Yuen trading as Fu Yuen Construction Co., did not appear. In their absence, the Adjudicator ordered them to pay the MPFA  $35,967.29, $34,100, $33,958.99, $25,200, $19,329.50, $18,965.55, $14,931.32, $13,500.83, $1,148.38 and $183.96, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered defendants to pay $236, $110, $198, $185, $290, $126, $136, $220, $106, $90, $150 and $100 respectively as the costs in respect of the claims.

     The Firm Limited previously pleaded guilty at Kwun Tong Magistracy to a count of failing to make MPF contributions on time and was fined $8,000.
