The following is issued on behalf of MPFA:
Two directors and five employers were fined $63,000 at the Kwun Tong Magistracy today (August 6), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.
Huang Chi Hong, director of Polylink (International) Cargo Service Limited, was charged with offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between February and March, 2006, and November 2006 and January 2007. The defendant was fined $10,000 for the first summons and $2,500 each for the remaining summonses, totalling $20,000.
Wu Yin Fung, director of Joyful Management & Security Ltd, was charged with offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to two counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between March and April 2007. The defendant was fined $4,000 for the first summons and $1,500 each for the remaining summons, totaling $5,500.
Joyful Management & Security Ltd was charged with offences under section 7A(8) of the ordinance. The defendant pleaded guilty to two counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between March and April 2007. The defendant was fined $4,000 for the first summons and $1,500 each for the remaining summons, totaling $5,500.
Choi Ming Restaurant (Holdings) Limited was charged with offences under section 7A(8) of the ordinance. The defendant pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between October and December 2006. The defendant was fined $8,000 for the first summons and $2,500 each for the remaining summonses, totalling $13,000.
Harvard Engineering Limited was charged with an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to a count of failing to make MPF contributions for an employee within the prescribed time for the contribution period in December 2006. The defendant was fined $7,000 for the summons.
Fung Yuk Man trading as Man Yin Investment Development Co pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $4,000 for failing to enrol an employee in an MPF scheme as required by the ordinance.
Hoi On Security Company Limited pleaded guilty to an offence under section 7(1) of the ordinance. The defendant was fined $8,000 for failing to enrol an employee in an MPF scheme as required by the ordinance.
Meanwhile, the MPFA today pursued five claims in the Small Claims Tribunal for some $77,000 on behalf of seven employees, who were owed MPF contributions by their employers.
At the hearing, the defendants, Penon International Limited and Vigorous Property Management Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $35,850.24 and $6,258, being mandatory contributions in arrears and surcharges payable.
The other three defendants, Lee Tak Ming, Peter formerly trading as Transtronics (HK) Corp, Henry International Watch Company Limited and Ho Kei Tung trading as Gathering Restaurant, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $18,930.02, $16,567.85 and $7,346.76, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The Tribunal further awarded $156, $106, $160, $90 and $90 as the costs in respect of the claims.
