Shui Wing Contracting Company Limited was fined $27,000 at Sha Tin Magistrates' Court today (August 3) for violations of the Factories and Industrial Undertakings Ordinance and the Boilers and Pressure Vessels Ordinance (BPV Ordinance). The prosecutions were launched by the Labour Department.
The case involved drainage maintenance works at a construction site in Sha Tin on August 1, 2006. Two workers died after inhaling poisonous gas inside an underground sewage pipe.
According to Section 9(b) of the Factories and Industrial Undertakings (Confined Spaces) Regulation, the contractor must ensure a person remaining in confined space is properly wearing an approved breathing apparatus. Any contractor fails to do so is liable to a fine of $100,000 and to imprisonment for six months.
According to Section 49(1) of the BPV Ordinance, a contractor who fails to examine a boiler or pressure vessel is liable to a fine of $30,000.
