Five employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (July 24) obtained two orders in the District Court for payments of outstanding MPF contributions at about $780,000 against two employers. The MPFA also pursued three claims in the Small Claims Tribunal for some $20,000 on behalf of four employees who were owed MPF contributions by their employers.

     The District Court issued judgments against two employers, Plenty Profit Holdings Ltd trading as Lucky Fellow Restaurant and Join-in Green Products Company Limited. The defendants were ordered to pay the MPFA $754,723 and $32,223.07 respectively, being mandatory contributions in arrears and surcharges payable to 73 and four employees of the defendants.

     At the tribunal's hearing, the defendant, Poon Ng Tang trading as Pun Kee Construction Co, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $7,573.16, being mandatory contributions in arrears and surcharges payable.

     The other two defendants, Leung Kam Shing trading as Hong Kong Summax Electrical Appliance Company and CYS Engineering Company Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $11,739 and $3,778.41, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the tribunal further ordered each of the respective defendants to pay cost of $930 each for the District Court cases and $150, $150 and $96 for the tribunal cases.
