The Mandatory Provident Fund Schemes Authority (MPFA) today (July 16) pursued nine claims in the Small Claims Tribunal for some $160,000 on behalf of 42 employees, who were owed MPF contributions by their employers.
Three defendants, Yeung Sui Transportation Company Limited, Chan Wing Kei Vincenza and Chan Kin Bong trading as Oscar Collections and Leung Fai Kwong trading as Sun Fai Trading Co, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA $41,155.40, $29,122.58 and $5,835.34 respectively, being mandatory contributions in arrears and surcharges payable.
The Adjudicator also ordered Leung Fai Kwong trading as Sun Fai Trading Co to pay the MPFA the sum of $5,000 being financial penalty imposed by the MPFA for failure to make MPF contributions for employees.
The other six defendants, Hang Lee Industrial (Hong Kong) Limited, Lee Ying Wai Simon trading as Yueh Hsi Tyres & Vehicle Repairs Company, Yam Ka Man formerly trading as Chan¡¦s Congee, Ng Ping formerly trading as Yau Shing Civil Engineering Co, Celltei Products Design & Development Company Limited and Universal Optical Service Centre Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $37,948.72, $20,570.62, $15,685.50, $6,300, $2,101.74 and $478.88, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal further ordered defendants to pay $160, $200, $150, $176, $240, $150, $80, $76 and $76 respectively as the costs in respect of the claims.
