Employer fined for breaching MPFS Ordinance

    An employer was fined $33,500 at the Kwun Tong Magistracy today (July 13), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

     Gallantly Limited was charged with offences under section 7A(8) of the Ordinance. The defendant pleaded guilty to 20 counts of failing to make MPF contributions for its employees within the prescribed time for the contribution periods between May, 2004, and December, 2005. The defendant was fined $5,000 for the first summons and $1,500 each for the remaining summonses, totalling $33,500.

     Meanwhile, the MPFA obtained two orders in the District Court for payment of outstanding contributions at about $280,000 against two employers.

     The District Court issued a judgment against Kwan Lik Engineering (Asia) Limited. The defendant was ordered to pay the MPFA $151,839.73, being ORSO contributions in arrears and contribution surcharges payable to eight employees of the defendant.

     The District Court also issued a judgment against Igloo Company Limited. The defendant was ordered to pay the MPFA $135,804.75, being mandatory contributions in arrears and surcharges payable to eight employees of the defendant.

     The amounts awarded at the District Court will be reimbursed to the employees¡¦ accounts as soon as they are received by the MPFA. The District Court further ordered the defendants to pay costs of $930 for each District Court case.
