Four employers fined for breaching MPFS Ordinance

    Four employers were fined $94,100 at the Kwun Tong Magistracy today (May 7), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

     Yam Kai Tak, trading as Kin Yip Engineering Co, pleaded guilty to 30 counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between February, 2004, and August, 2006. The defendant was fined $6,000 for the first summons and $1,200 each for the remaining summonses, totalling $40,800.

     Brainson Limited  pleaded guilty to eight counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between January and August, 2006. The defendant was fined $7,000 for the first summons and $2,000 each for the remaining summonses, totalling $21,000.

     Rise Glory Limited trading as Lucky House Restaurant pleaded guilty to 12 counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between August, 2005, and July, 2006. The defendant was fined $6,000 for the first summons and $1,300 each for the remaining summonses, totalling $20,300.

     Pacific Long Distance Telephone Corporation Limited pleaded guilty to an offence under section 7(1) of the Ordinance and was fined $12,000 for failing to enrol its employee in an MPF scheme as required by the ordinance.

     The MPFA today pursued 12 claims in the Small Claims Tribunal for some $260,000 on behalf of 46 employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing, the defendants, Yeung Sui Transportation Company Limited, Chan Ho Kit trading as Park Lane Dry Clean and Laundry Co and Chan Wai Leung, Chan Kwok Keung & Chan Pong Keung trading as Chan Kee Electrical Eng Co, did not dispute the amount claimed. The Adjudicator ordered them to pay the MPFA the sums of $30,244.94, $19,725 and $18,656.6, being mandatory contributions in arrears and surcharges payable.

     The other nine defendants - Magic Yield Limited trading as Blissful BBQ Goose & Hot Pot Restaurant(formerly known as Very Good Restaurant), Creator Investment Limited trading as New Choice Seafood Restaurant, The Park Language Group Limited, Lee Ying Fat trading as Kui Wing, AMZ Technology Limited formerly known as Logitech Limited, Hopewell Container Transportation Limited, Tam Tak Kuen trading as Alfred T.K. Tam & Co., Linkwill Development Limited and Wo Ming Engineering Limited - did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $49,388.22, $47,804.98, $22,545.5, $22,443.75, $21,901.02, $15,286.62, $9,922.5, $5,000 and $171.11, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further awarded $210, $230, $220, $160, $190, $120, $120, $152, $96, $180, $186 and $76 as the costs in respect of the claims.

     Yeung Sui Transportation Company Limited and The Park Language Group Limited pleaded guilty at Kwun Tong Magistracy earlier to 14 counts of failing to make MPF contributions on time and were fined $25,500 and $18,000 respectively.
