Five employers ordered to pay MPF non-payment

    The Mandatory Provident Fund Schemes Authority (MPFA) today (September 14) obtained an order in the District Court against an employer for payment of outstanding MPF contributions of more than $230,000. The MPFA also pursued four claims in the Small Claims Tribunal for some $80,000 on behalf of eight employees, who were owed MPF contributions by their employers.

     The District Court today issued a judgment against the employer, Binary Consultants Limited. The defendant was ordered to pay the MPFA $239,447.32, being mandatory contributions in arrears and surcharges payable to four employees of the defendant.

     At the Tribunal's hearing today, the defendants, Chui Kwan Woo trading as Tai Fook Engineering Company and Chan Woon Cheong trading as Chan Cheong Company, did not dispute the amounts claimed.  The Adjudicator ordered them to pay the MPFA  $48,033.69 and $4,080.82, being mandatory contributions in arrears and surcharges payable.

     The other two defendants, including Leung Shing Kit trading as Forever Video CD Co and Choices Limited trading as Yat Lung Garment Factory, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA $22,644.97 and $4,988.83, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court case and $230, $120, $190 and $180 as the costs in respect of the Small Claims Tribunal cases.
