Employer fined for breaching MPFS Ordinance

    An employer was fined $10,000 at the Kwun Tong Magistracy today (September 5), after being convicted of an offence under the Mandatory Provident Fund Schemes Ordinance. The authority also pursued four claims in the Small Claims Tribunal for some $62,000 on behalf of seven employees, who were owed MPF contributions by their employers.

     AMJ Transportation Limited (BR no.: 33885714) was charged for an offence under section 7A(8).  The defendant pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between January and March, 2005.  The defendant was fined $6,000 for the first summons and $2,000 each for the other summonses, totalling $10,000.

     At the tribunal's hearing today, Eternal Gain (Hong Kong) Limited trading as Pei Ho Ping Kee Seafood Roasted Meat Restaurant, did not dispute the amount claimed.  The Adjudicator ordered it to pay the MPFA the sum of $2,550, being mandatory contributions in arrears and surcharge payable.

     The other three defendants, Samlane Human Resources Limited, Mo Suk Mun trading as Small Potato and Chan Choi Lit trading as Myeyes Optical Company, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $33,248.32, $23,601.79 and $2,593.75, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA.  The court further awarded payments of $60, $340, $120 and $140 as the costs in respect of the claims.
