Two company directors and two employers fined for breaching MPFS Ordinance

    Two company directors and two employers were fined $54,000 at the Kwun Tong Magistrates' Courts today (September 4), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Lam Kin Lan, Director of AMJ Transportation Limited (BR no.: 33885714), was charged with offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to three counts of failing to make MPF contributions for his employee within the prescribed time for the contribution period between January and March 2005. The defendant was fined $8,000 for the first summons and $2,000 each for the other summonses, totalling $12,000.

     Meanwhile, Lam Kin Lan, trading as AMJ Transportation Company (BR no.: 21130163), was also charged with an offence under section 7A(8). The defendant pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution period between December 2003 and March 2004. The defendant was fined $8,000 for the first summons and $2,000 each for the other summonses, totalling $12,000.

     Tong Hoi Yan Estella, Director of Cheer Genius Industrial Limited (BR no.: 18577774), which was charged with offences under section 7A(8) and section 44 of the ordinance, the defendant pleaded guilty to seven counts of failing to make MPF contributions within the prescribed time for the contribution period in October 2005 to April 2006. The defendant was fined $8,000 for the first summons and $2,000 each for the remaining summonses, totalling $20,000.

     Hallmark Fashions Limited (BR no.:12815231), which was charged with an offence under section 7A(8) of the ordinance, the defendant pleaded guilty to three counts of failing to make MPF contributions within the prescribed time for the contribution period from December 2005 to March 2006. The defendant was fined $6,000 for the first summons and $2,000 each for the remaining summonses, totalling $10,000.
