The Mandatory Provident Fund Schemes Authority (MPFA) today (August 30) pursued 11 claims in the Small Claims Tribunal for some $280,000 on behalf of 31 employees, who were owed MPF contributions by their employers.
At today's hearing, six defendants - Superior Removal & Transportation Limited, Jet Data Company Limited, Goodtimes Trading Limited, To Kan trading as Kan Kee Transportation Company, Hui Hong Por trading as Yat Luen Engineering Company and Hathey International Holdings Limited - did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $44,412.58, $42,963.02, $41,896.54, $32,791.5, $19,048.8 and $9,047.78, being mandatory contributions in arrears and surcharges payable.
The other five defendants, Maxwell Engineering Limited, Elton S Y Chow trading as Elton S Y Chow & Associates, Genesis Engineering Transportation Company Limited, Hong Kong Pre-fabricated Products Limited and Cheung Yat Wing trading as Wing Lok Electrical Engineering, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $43,890, $27,825, $15,554.13, $1,853.1 and $1,137.68, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $180, $340, $170, $170, $120, $90, $170, $190, $90, $190 and $120 as the costs in respect of the claims.
Superior Removal & Transportation Limited and Genesis Engineering Transportation Company Limited pleaded guilty at Kwun Tong Magistracy earlier to 12 and 13 counts of failing to make MPF contributions on time and were fined $30,000 and $38,000 respectively.
