A company director was fined $26,000 at the Kwun Tong Magistracy today (August 22), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.
Ho Ka Cheung, director of Focus Roller Shutter Limited, was charged for offences under section 7A(8) and section 44 of the Ordinance. The defendant pleaded guilty to 10 counts of failing to make MPF contributions for his employee within the prescribed time for the contribution periods between April, 2004, and January, 2005. He was fined $8,000 for the first summons and $2,000 each for the other nine summonses, totalling $26,000.
Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today obtained three orders for payment of outstanding MPF contributions at around $810,000 against three employers in the District Court. MPFA today also pursued a claim in the Small Claims Tribunal for some $20,000 on behalf of an employee, who was owed MPF contributions by its employer.
The District Court today issued three judgments against three employers, Dickson Construction Company Limited, Dickson Construction (Maintenance) Limited and Dickson Design Services Limited. The defendants were ordered to pay the MPFA the sums of $485,902.14, $233,818.8 and $97,143.57, being mandatory contributions in arrears and surcharges payable to 191, 80 and 33 employees.
At the Tribunal's hearing today, the defendant, Lik Keung Engineering Limited, did not appear. In its absence, the Adjudicator ordered it to pay the MPFA the sum of $22,321.48, being mandatory contribution in arrears and surcharge payable.
The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for each District Court case and $390 for the Tribunal case as costs in respect of the claims.
