The Mandatory Provident Fund Schemes Authority (MPFA) today (2 August) obtained an order for payment of outstanding MPF contributions at around $170,000 against an employer in the District Court. MPFA today also pursued five claims in the Small Claims Tribunal for some $30,000 on behalf of seven employees, who were owed MPF contributions by their employers.
The District Court today issued a judgement against an employer, namely, Lung Tak Seng trading as Tak Fai Metal Works. The defendant was ordered to pay the MPFA the sum of $174,932.97, being mandatory contributions in arrears and surcharges payable to four employees of the defendant.
At the Tribunal's hearing today, the defendant, Lee Kai Leung Anthony trading as Advanced Digi Photo Centre, did not dispute the amount claimed. The Adjudicator ordered the employer to pay the MPFA the sum of $6,595.22, being mandatory contributions in arrears and surcharges payable.
The other four defendants, including China Smartly Limited trading as Hoi Fai Seafood Hot Pot Restaurant, Mak Yat Kwai trading as Yat Kwai Company, Precision Tune Auto Care (China) Company Limited and Fook Wing (Worldwide) Company Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $9,081.45, $7,692.46, $6,031.46 and $2,039.2, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court and the Tribunal respectively further awarded payments of $930 for the District Court cases and $190, $80, $90, $300 and $220 for the Tribunal cases as costs in respect of the claims.
China Smartly Limited trading as Hoi Fai Seafood Hot Pot Restaurant pleaded guilty at Kwun Tong Magistracy earlier to a count of failing to make MPF contributions on time and was fined 4,000.
