Nine employers fined for breaching MPFS Ordinance

    Nine employers were fined a total of $112,300 at the Kwun Tong Magistracy today (December 5), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

     In the first case, the defendant, Armed Forces Security (H.K.) Limited, pleaded guilty to two counts of failing to make MPF contributions on time, after making deduction from the income of an employee between February and March, 2005.  The defendant was fined $5,000 for the first summons and $2,000 for the second, totalling $7,000.

     In the second case, Pacific Long Distance Telephone Corporation Limited, pleaded guilty to four counts of failing to make MPF contributions on time, after making deduction from the income of an employee between September and December, 2004.  The defendant was fined $4,000 for the first summons and $1,500 for each of the other three summonses, totalling $8,500.

     In the third case Superior Removal & Transportation Limited, pleaded guilty to 12 counts of failing to make MPF contributions on time, after making deduction from the income of an employee between January and December 2004.  The defendant was fined $8,000 for the first summons and $2,000 for each of the other 11 summonses, totalling $30,000.

     In the fourth case, Smart Loyal Investment Limited, pleaded guilty to four counts of failing to make MPF contributions on time, after making deduction from the income of an employee between April and July, 2005.  The defendant was fined $5,000 for the first summons and $2,000 for each of the other three summonses, totalling $11,000.

     In the fifth case, Eaglefair Management Limited, pleaded guilty to three counts of failing to make MPF contributions on time, after making deduction from the income of an employee between April and June, 2005.  The defendant was fined $4,000 for the first summons and $1,000 for each of the other two summonses, totalling $6,000.

     In the sixth case, Hong Kong City Service Centre Limited, pleaded guilty to nine counts of failing to make MPF contributions on time, after making deduction from the income of an employee between October, 2004, and June, 2005.  The defendant was fined $5,000 for the first summons and $1,500 for each of the other eight summonses, totalling $17,000.

     In the seventh case, Success Fly Holdings Limited, pleaded guilty to four courts of failing to make MPF contributions on time, after making deduction from the income of an employee between January and April, 2005.  The defendant was fined $4,000 for the first summons and $1,000 for each of the other three summonses, totalling $7,000.

     In the eighth case, Lee Siu Hung trading as Golden View Transportation Co., pleaded guilty to three counts of failing to make MPF contributions on time for an employee between July and September, 2002. The defendant was fined $6,000 for the first summons and $2,000 for each of the other two summonses, totalling $10,000.

     In the ninth case, Kay Drycleaning & Laundry Company Limited, pleaded guilty to 10 counts of failing to make MPF contributions on time, after making deduction from the income of an employee between April, 2004, and January, 2005. The defendant was fined $5,000 for the first summons and $1,200 for each of the other nine summonses, totalling $15,800.

     Meanwhile, the Mandatory Provident Fund Schemes Authority (MPFA) today pursued two claims in the Small Claims Tribunal for some $32,000 on behalf of five employees, who were owed MPF contributions by their employers.

     The two defendants, Shangri La Limited trading as Soong Dynasty Restaurant and First Institute of Art & Design Limited, did not appear at today's hearing.  In their absence, the Adjudicator ordered them to pay the MPFA the sums of $27,756.63 and $4,858.03 respectively, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA.  The court further awarded payment of $340 and $230 as costs in respect of the claims.
