Two companies Fined $18,000 for MPF offences

Two employers were fined a total of $18,000 at the Kwun Tong Magistracy today (August 25), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

In the first case, the defendant, Pakco Property Services Limited pleaded guilty to three counts of failing to make MPF contributions on time for an employee between July 2002 and September 2002. The defendant was fined $4,000 each for the first two summonses, and $2,000 for the remaining summons, totaling $10,000.

In the second case, the defendant, Chuen Lee Chuen Tung Limited pleaded guilty to a charge of failing to enroll an employee in an MPF scheme. The defendant was fined $8,000 for the summons.

MPFA wins ten claims for MPF non-payment

In the Small Claims Tribunal today, the Mandatory Provident Fund Schemes Authority (MPFA) pursued ten claims for some $170,000 on behalf of 20 employees, who were owed MPF contributions by their employers.

The defendants were Starpaging Air Express Limited, Scorer Lounge Limited, Eagle City Limited trading as Fook Ying Seafood Restaurant, Great Sure Limited trading as Macau South Bay Restaurant, Avalon Pacific Limited, Mok Leung trading as Tung Man Trading Transportation Company, Cheong Fat Enterprises Limited trading as Lucky Star Seafood Restaurant, V.A. Management Limited, Chung Tak Wai, Chan Chui Ngor and Ngo Kam Hoi trading as Chung Ngan China-H.K. Transportation Company and Yiu Kam Lung trading as Ho Ye Cleaning Service Company.

At today's hearing, Avalon Pacific Limited did not dispute the amount claimed. The Adjudicator ordered her to pay the MPFA the sum of $16,922.87, being mandatory contributions in arrears and surcharges payable.

The other defendants, namely, Starpaging Air Express Limited, Scorer Lounge Limited, Eagle City Limited trading as Fook Ying Seafood Restaurant, Great Sure Limited trading as Macau South Bay Restaurant, Mok Leung trading as Tung Man Trading Transportation Company, Cheong Fat Enterprises Limited trading as Lucky Star Seafood Restaurant, V.A. Management Limited, Chung Tak Wai, Chan Chui Ngor and Ngo Kam Hoi trading as Chung Ngan China-H.K. Transportation Company and Yiu Kam Lung trading as Ho Ye Cleaning Service Company did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sum of $48,743.64, $25,020.90, $21,034.60, $20,364.59, $14,081.08, $9,166.54, $7,386.46, $7,168.36 and $1,055.36 respectively, being mandatory contributions in arrears and surcharges payable.

The amounts awarded will be reimbursed to the relevant employees' MPF account as soon as they are received by the MPFA. Amounts of $530, $350, $370, $110, $190, $250, $180, $240, $590 and $140 were also awarded respectively as costs in respect of the claims.
