Company Fined $17,500 for MPF non-contribution

Yes Communication Limited was fined $17,500 at the Kwun Tong Magistracy today (July 15), after pleading guilty to 12 charges of failing to make MPF contributions on time, after making deductions from the income of two employees between September 2002 and March 2003. The defendant was fined $4,000 for the first summons, $1,000 each for other six summonses, and $1,500 each for the other five summonses, totaling $17,500.

MPFA wins eight claims for MPF non-payment

In the Small Claims Tribunal today, the Mandatory Provident Fund Schemes Authority (MPFA) pursued eight claims for some $18,500 on behalf of 17 employees, who were owed MPF contributions by their employers

The defendants were Southwell Engineering Limited, Hin Sum Manpower Company Limited, Wai Sing Construction Engineering Company Limited, Fong King Chuen Albert trading as Kin Bong Electrical & Mechancial Engineering Company, Kang Kwong Fai Construction Company Limited, Plentiway Management Limited, Leung Do Fun, Dennis trading as Dragon Industrial Company and Base Long Limited.

Southwell Engineering Limited, Hin Sum Manpower Company Limited and Hin Sum Manpower Company Limited pleaded guilty at Kwun Tong Magistracy earlier to 10, 6 and 8 counts of MPF offences, convicted and were fined $22,000, $21,000 and $12,000 respectively.

At today's hearing, Hin Sum Manpower Company Limited, Fong King Chuen Albert trading as Kin Bong Electrical & Mechancial Engineering Company and Base Long Limited did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sum of $41,388.64, $29,830.98 and $5,513.11, being mandatory contributions in arrears and surcharges payable.

The other defendants, namely, Southwell Engineering Limited, Wai Sing Construction Engineering Company Limited, Kang Kwong Fai Construction Company Limited, Plentiway Management Limited and Leung Do Fun, Dennis trading as Dragon Industrial Company. In their absence, the Adjudicator ordered them to pay the MPFA the sum of $43,178.01, $38,556.71, $16,042.69, 6,589.24 and $4,819.40 respectively, being mandatory contributions in arrears and surcharges payable.

The amounts awarded will be reimbursed to the relevant employees' MPF accounts as soon as they are received by the MPFA. Amounts of $160, $170, $180, $120, $190, $100, $250 and $260 were also awarded respectively as costs in respect of the claims.
