The Mandatory Provident Fund Schemes Authority (MPFA) today (July 10) pursued eight claims in the Small Claims Tribunal, totaling some $238,000 on behalf of 22 employees, who were owed MPF contributions by their employers.
The defendants were Kenford International Investment Limited trading as Golden Palace Chiu Chow Restaurant, Fong King Chuen Albert trading as Kin Bong Electrical & Mechanical Engineering Company, Poon Ping Ki trading as Pokin Engineering Company, Sunlink Limited, Southwell Engineering Limited, Million Rainbow Limited, Wah Chack Engineering & Trading Company Limited and Tsui Chi Hung trading as Collective.
Sunlink Limited, Southwell Engineering Limited and Million Rainbow Limited pleaded guilty at Kwun Tong Magistracy earlier to nine charges, ten charges and two charges of MPF offences and were convicted and fined a total of $31,000, $22,000 and $11,000 respectively.
At today's hearing, Fong King Chuen Albert trading as Kin Bong Electrical & Mechanical Engineering Company, Million Rainbow Limited and Tsui Chi Hung trading as Collective did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sum of $41,034.71, $31,742.10 and $2,454.54 respectively, being mandatory contributions in arrears and surcharges payable.
The other defendants, Kenford International Investment Limited trading as Golden Palace Chiu Chow Restaurant, Poon Ping Ki trading as Pokin Engineering Company, Sunlink Limited, Southwell Engineering Limited and Wah Chack Engineering & Trading Company Limited did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA the sum of $48,250, $36,461.34, $36,241.87, $35,627.33 and $6,573.26 respectively, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The court further awarded payments of $160, $330, $270, $280, $320, $380, $280 and $240 as costs in respect of the claims.
