Reminder on wage level for foreign domestic helpers

The Labour Department reminded employers of foreign domestic helpers (FDHs) to pay their FDHs wages according to the employment contract, which should be no less than the minimum allowable wage of $3,860 per month stipulated by the Government.

"We are very concerned about media reports that some FDHs are being recruited and paid at wages less than the minimum allowable wage," a department spokesman said.

"Employers should pay their FDHs no less than the wage amounts specified in their standard employment contracts. Such amount should not be less than the minimum allowable wage which currently stands at $3,860 per month as stipulated by the Government," the spokesman said.

Under the Employment Ordinance, underpayment of wages is a prosecutable offence. An employer who underpays his employee is liable to prosecution and, upon conviction, to a maximum fine of $200,000 and to imprisonment for one year.

"Any FDH who is being underpaid is advised to approach the Labour Relations Service of the Labour Department for advice and assistance," the spokesman said.

"All complaints alleging underpayment of wages will be investigated by the department.

The spokesman also reminded employment agencies that they should not conduct job placements involving FDHs at wages lower than the minimum allowable wage.

"FDHs who want to know their rights and benefits may obtain a copy of the Guide to the Provisions of the Employment Ordinance and the Employment Contract for FDHs published by the Labour Department, or telephone 2717 1771 for enquiries," the spokesman said.
