Dear Sir / Madam,

Lists of names for suspicious account reporting – US Executive Order and Government Gazette

Further to my letter of 25 February 2003, I am writing to inform you that the US Government has designated additional names under the US Executive Order issued on 23 September 2001. The latest list can be found in the website of the Office of Foreign Assets Control of the US Treasury (www.ustreas.gov/offices/enforcement/ofac/sanctions/terrorism.html) under names designated on 28 February 2003.

Meanwhile, a new consolidated list of names has been designated under both the United Nations (Anti-terrorism Measures) Ordinance (“Ordinance”) and the United Nations Sanctions (Afghanistan) Regulation (“Regulation”). The lists have been published in the Gazette on 7 March 2003 under G.N.1417 and G.N.1418 respectively. You may access the website of the Printing Department at www.info.gov.hk/pd for the gazetted lists. Meanwhile, a copy each of the lists in MS Word format is attached to facilitate update of your electronic database (Annex).

The lists designated separately under the Ordinance and the Regulation are both made pursuant to the list released by the United Nations Security Council Committee on 24 February 2003, and are therefore identical.

Compared to the list advised in my letter of 16 December 2002, the following names have been added under United Nations Security Council Resolution 1333:

You are reminded to check the designated names against your records and report any transactions or relationships you have or have had with the named individuals or entities to the Joint Financial Intelligence Unit and the HKMA.

You are also reminded to put in place measures to ensure that your institution complies with the provisions of the Ordinance and the Regulation.
