North Point Fulum Palace convicted for generating excessive noise from its air conditioning system

     The air conditioning system of a restaurant in North Point, Fulum Palace, generated excessive noise and adversely affected nearby residents. Its operating company was fined $10,000 by Eastern Magistrates' Courts today (February 5) for contravening the Noise Control Ordinance (NCO).

     An Environmental Protection Department (EPD) spokesman said that the department received a complaint from the resident of a mixed commercial and residential building at King's Road, North Point last February. Upon investigation and noise assessment, EPD's enforcement staff found that the noise level caused by the air conditioning system of Fulum Palace located at the building exceeded the statutory limit. The department subsequently issued a noise abatement notice under the NCO to the operating company of the restaurant, requesting it to take mitigation measures. In its follow-up inspection, the EPD found that the remedial works conducted by the company still did not effectively reduce the noise to within the statutory limit. The department subsequently prosecuted the operating company and requested it to follow up and rectify the irregularity as soon as possible, otherwise it will be prosecuted again.

     The spokesman reminded all restaurant operators that they should hire the services of qualified professionals for the installation of air conditioning system. Proper vibration isolation and noise abatement devices should be in place to avoid generating excessive noise and causing nuisance to nearby residents.

     According to the NCO, anyone who violates the requirements of the noise abatement notice commits an offence. First-time offenders are liable to a maximum fine of $100,000. A maximum fine of $200,000 may be imposed on second or subsequent convictions. Relevant company directors may also be prosecuted.
