K. Wah asphalt plant in Sheung Shui convicted for violating APCO licence conditions

A spokesman for the Environmental Protection Department (EPD) said that during an inspection on the plant's first day of operation this April, EPD staff found that exhaust gas was emitted from a non-permitted point. A dump truck leaving the plant also did not go through the vehicle washing facility, thus taking dust to areas outside the asphalt plant and violating the specified process licence conditions. Upon investigation and evidence gathering, the department subsequently initiated prosecution against the asphalt factory in accordance with the APCO.
The spokesman said that the production of asphalt may cause serious pollution and is thus covered by the strict control of the specified process licence under the APCO. Relevant licence holders should ensure that the pollution preventive measures are being maintained and conducted properly to effectively prevent causing air pollution and avoid adversely affecting the health of nearby residents.
According to the APCO, it is an offence if anyone fails to observe the specified process licence conditions. First-time offenders are liable to a maximum fine of $100,000. Upon second or subsequent conviction, a maximum fine of $200,000 and six months' imprisonment may be imposed.
