Tuen Mun construction site contractor convicted for illegal discharge of muddy water into communal storm drainage system

     The contractor of a construction site in Tuen Mun who illegally discharged wastewater into the communal storm drainage system was fined $12,000 by Fanling Magistrates' Courts today (August 15) for contravening the Water Pollution Control Ordinance (WPCO).

     During a surprise inspection in December 2016, staff of the Environmental Protection Department (EPD) found that the construction site at Tong Hang Road in Tuen Mun Area 54 discharged untreated muddy water into the communal storm water drainage system. EPD staff took a wastewater sample for analysis and the result confirmed that the concentration of suspended solids was 22 000 milligrams per litre, far exceeding the statutory limit by about 730 times. The wastewater caused pollution to the water quality of the Tuen Mun River. Upon investigation and evidence collection, the EPD initiated prosecution against the contractor according to the WPCO.

     An EPD spokesman said that contractors of construction sites should install proper wastewater treatment facilities and maintain their effective operation to ensure that the discharge meets the statutory limits to avoid polluting rivers, communal drains or coastal environments.

     Under the WPCO, it is an offence for anyone to discharge polluted water into the communal drainage system or water bodies. First-time offenders are liable to a maximum fine of $200,000 and six months' imprisonment. A maximum fine of $400,000 and six months' imprisonment may be imposed on second or subsequent convictions.
