Construction company convicted for illegally carrying out works at night

     A construction contractor, which failed to carry out construction works in accordance with the requirements of a construction noise permit (CNP) in the Kai Tak Development Area, was fined $30,000 by Kwun Tong Magistrates' Courts today (March 30) for contravening the Noise Control Ordinance (NCO).

     A spokesman for the Environmental Protection Department (EPD) said that the department had earlier received a complaint in September 2016 on the noise nuisance generated by the evening construction works in a construction site within 200 metres of Tak Long Estate in the Kai Tak Development Area. During a blitz operation conducted by EPD staff, the construction site was found using a concrete pump lorry in concrete works at around 7.30pm, thus causing a noise nuisance. According to the CNP issued by the EPD to the construction site, the contractor can only use quiet powered mechanical equipment during restricted hours (between 7pm and 7am the next day and on a general holiday). The EPD subsequently revoked the construction site's CNP and prosecuted the related contractor following the completion of the evidence gathering process.

     The spokesman said construction noise will disturb the rest of the surrounding neighbourhood. Members of the construction sector should properly manage their works. They should neither carry out works outside restricted hours nor use prohibited powered mechanical equipment during restricted hours. They must also abide by the requirements of the CNP, as otherwise it is an offence and offenders will be prosecuted. 

     Under the NCO, first-time offenders are liable to a maximum fine of $100,000. A maximum fine of $200,000 may be imposed on second or subsequent convictions, and a further fine of $20,000 for each day during which the offence has continued.
