Laundry workshop and restaurant in Kwai Chung fined for illegal installation of boiler and cooking stoves

     A laundry workshop and a restaurant, which failed to obtain prior approval from the Environmental Protection Department (EPD) for installing a boiler and cooking stoves respectively, were convicted by the Fanling Magistrates' Courts today (November 29) for contravening the Air Pollution Control (Furnaces, Ovens and Chimneys) (Installation and Alteration) Regulations. The restaurant was fined $6,000. The Courts also ordered the laundry workshop to submit to the EPD its installation plan with specifications of the equipment for approval within 28 days, and adjourned the sentence to the end of January next year.
 
     A spokesman for the EPD said that during the investigation of public complaints against air pollution nuisances in June and July this year, the EPD found that no prior applications for the installation of the boiler used by a laundry workshop at Kwai Hei Street, the cooking stoves at a restaurant at Wo Tong Tsui Street in Kwai Chung and the exhaust systems of the two premises were made to the department. The EPD subsequently initiated prosecution against the laundry workshop and the restaurant.
 
     As stipulated by the Regulations, application for the installation or alteration of furnaces, ovens, chimneys or flues exceeding the allowable total fuel consumption capacity should be submitted to the EPD for approval prior to the commencement of such works. Offenders are liable to a maximum fine of $50,000 and a daily fine of $500 may be imposed for a continuing offence. In addition, the Courts may order the offenders to submit to the EPD their installation or alteration plans with specifications of the equipment for approval within 28 days and may prohibit the operation of the equipment or order the offenders to dismantle the equipment.
 
     The spokesman reminded members of the laundry and food businesses that if the fuel consumption capacity of the proposed fuel-burning equipment has exceeded the exemption limit, operators should submit applications to the EPD in accordance with the requirements of the Regulations and the installation or alteration works can only be carried out after getting approval from the EPD to avoid contravening the law. The exhaust system and other air pollution control system of fuel-burning equipment should be properly designed to avoid causing pollution to the air or nuisances to the public.
