Lorry owner convicted for failing to provide information in illegal waste disposal case

     A lorry owner who failed to provide information to the Environmental Protection Department (EPD) in an investigation on a suspected illegal disposal of construction waste was convicted and fined $8,000 at Fanling Magistrates' Courts today (October 11).

     An EPD spokesman said that the surveillance camera installed at Kwai Hei Street in Kwai Chung captured two incidents of illegal disposal of construction waste by the same lorry last year. Based on the information recorded by the surveillance system, the identity of the vehicle owner was discovered. The lorry owner admitted that he hired a driver to transport asphalt for a road-paving works, and the driver dumped the leftover asphalt on the street. However, the lorry owner refused to provide the driver's contact information, thus contravening the Waste Disposal Ordinance (WDO).

     According to Section 23B of the WDO, anyone who fails to provide information as required by the authority without reasonable excuse commits an offence and is liable to a maximum fine of $100,000.

     The spokesman reminded members of the logistics and transportation sector to take all proper precautions and exercise due diligence to dispose of waste in accordance with relevant laws and to avoid illegal disposal of waste. Employers or vehicle owners should be co-operative in assisting EPD's investigation on cases of illegal waste disposal which involve their vehicles.
