Government's response to media enquiries

     In response to media enquiries on the appointment of chairpersons and members to the councils of universities, a Government spokesman said today (January 3):

     "The Government attaches great importance to implementing the Basic Law and upholding academic freedom and institutional autonomy. The eight University Grants Committee (UGC)-funded institutions are all independent and autonomous statutory bodies. They have their own governing ordinances and statutes which set out their objectives, functions and governance structure. The legislation provides the institutions with the power and freedom to carry out their objectives and functions.

     As for the appointment of chairpersons and members to the councils of universities, the Government's decisions are based on the merits of individuals, including their ability, expertise, experience, integrity and commitment to public service. The Government will also consider the operation of universities and the development needs of higher education in Hong Kong in making appropriate appointments.

     According to the respective ordinances governing the eight UGC-funded institutions, the Chief Executive is the Chancellor of the institutions. Relevant provisions in the ordinances and statutes of the institutions specify the powers of the Chancellor. This statutory system has been operating effectively over the years and there is no interference with academic freedom and institutional autonomy. We urge that individuals show respect to the ordinances.

     We respect the right of the individuals to express their views but the views should be based on facts. They must abide by the law and respect the rule of law."
