This press release summarises the Communications Authority (CA)'s decisions at its 28th meeting in February 2014:
Hutchison Telephone Company Limited (HTCL) in breach
of Section 7M of Telecommunications Ordinance (TO)

The CA considered a complaint against HTCL for breaching section 7M of the TO. The complainant alleged that HTCL's salesperson had engaged in misleading or deceptive sales conduct by not disclosing to him the data speed restriction under the mobile service plan being promoted to him, thereby contravening section 7M of the TO. Having considered the findings of the investigation conducted by the Office of the Communications Authority, the CA was of the view that HTCL had engaged in misleading or deceptive conduct in breach of section 7M of the TO. The CA concluded that a financial penalty of HK$60,000 imposed on HTCL was proportionate and reasonable in relation to the breach concerned. Broadcast complaints

The CA also considered two complaint cases in respect of Television Broadcasts Limited (TVB)'s non-compliance with the relevant codes of practice on programme and advertising standards:
(a) a complaint against the television programme "The Taste of Taipan Snowy Mooncakes Mini 2013" broadcast on the HD Jade Channel of TVB in September 2013. The CA decided that a financial penalty of $100,000 should be imposed on TVB for breaching the relevant provisions in the Generic Code of Practice on Television Programme Standards (TV Programme Code) and the Generic Code of Practice on Television Advertising Standards (TV Advertising Code); and
(b) complaints against the television programmes "News at 6.30" and "News Roundup" broadcast on the Jade, HD Jade and I News Channel of TVB on September 8, 2013. The CA decided that TVB should be advised to observe more closely the relevant provisions in the TV Programme Code.
