Hung Lik Engineering Limited and one worker employed by this company were fined $20,000 and $10,000 respectively at Fanling Magistrates' Court today (January 3) for violation of the Factories and Industrial Undertakings Ordinance. The prosecution was launched by the Labour Department.
The case involved an accident that occurred on May 16 last year at a container depot in Yuen Long in which two workers were fatally injured by the wheel of a reach stacker during its dismantling.
According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, a proprietor shall provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risk to the health of the persons employed. Any proprietor who fails to do so is liable to a fine of $500,000.
According to Section 6B(1)(a) of the Factories and Industrial Undertakings Ordinance, every person employed at an industrial undertaking while at work shall take reasonable care for the health and safety of himself and of other persons who may be affected by his acts or omissions at work. Any person who fails to do so is liable to a fine of $25,000.
According to Section 10(3)(b) of the Factories and Industrial Undertakings Ordinance, any person who recklessly gives false information as to any of the matters in respect of which information is required to be given under Section 4(1) of the Factories and Industrial Undertakings Ordinance is liable to a fine of $50,000.
