Proprietors fined for violation of safety rules

     Koon Wah Mirror Factory Limited and Koon Wah Transportation Company were fined $22,500 and $10,000 respectively at Shatin Magistrates' Court today (July 29) for violation of the Factories and Industrial Undertakings Ordinance and the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations. The prosecution was launched by the Labour Department.

     The case involved a fatal accident that occurred on December 31 last year at a workplace at Shatin, in which a worker was trapped between collapsed crates of glass and subsequently died.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor shall provide and maintain a system of work that is safe and without risk to the persons employed. Any proprietor who fails to do so is liable to a fine of $500,000.

     According to Regulation 12 of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the owner shall ensure that a lifting appliance is not used if it is loaded beyond the maximum safe working load. Any owner who fails to do so is liable to a fine of $200,000.
