Conviction of making false statement to claim MPF benefits

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Three Mandatory Provident Fund (MPF) scheme members were convicted today (May 3) at Kwun Tong Magistrates' Courts for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance (the Ordinance) by making false or misleading statements in documents to MPF trustees and were each fined $6,000.

     According to the prosecution, the defendants, Thapa Tej Kumari, Garbuja Ghan Bahadur and Law Tsz Wang Terence, applied to MPF trustees on May 11, March 23 and March 17, 2010 respectively for early withdrawal of their MPF accrued benefits on the grounds of permanent departure. Investigation by the Mandatory Provident Fund Schemes Authority (MPFA) found that the defendants had provided a false or misleading statement in claiming that they had not previously claimed payment of accrued benefits on the ground of permanent departure on an earlier departure date.

     Meanwhile, four employers were fined a total of $168,000 at Kwun Tong Magistrates' Courts today after being convicted of offences under the Ordinance.

     Kai King Transportation Co., Limited (BR no.: 20981305) was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to a count of failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Kai King Transportation Co., Limited was also charged with an offence under section 7A(8) of the Ordinance and pleaded guilty to 21 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods from October 2008 to June 2009 and from September 2009 to August 2010. The defendant was fined $2,000 for the first summons, $4,000 for each of 10 summonses and $3,000 for each of the remaining 10 summonses, totalling $72,000.

     Dessange Group Limited (BR no.: 39827243) was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to a count of failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Dessange Group Limited was also charged with an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 10 counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods from December 2009 to September 2010. The defendant was fined $3,000 for each summons, totalling $30,000.

     WFL Printing Ltd (BR no.: 35566621) was charged with an offence under section 43E(1) of the Ordinance for making a false or misleading statement. The defendant pleaded guilty to a count of misreporting the employment date of an employee in a document to a trustee. The defendant was fined $6,000 for the summons.

     WFL Printing Ltd was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to a count of failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     WFL Printing Ltd was also charged with an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to three counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods from October to December 2009. The defendant was fined $3,000 for each summons, totalling $9,000.

     WFL Printing Ltd was also charged with an offence under section 7A(8) of the Ordinance and pleaded guilty to 3 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods in January, February and July 2010. The defendant was fined $3,000 for each summons, totalling $9,000.

     Lock Cha Tea House Limited (BR no.: 35794266) was charged with an offence under section 7(1) of the Ordinance. The defendant pleaded guilty to a count of failing to enrol an employee in an MPF scheme as required by the Ordinance and was fined $6,000 for the summons.

     Lock Cha Tea House Limited was also charged with an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions to the MPFA for an employee who was not a member of a registered scheme within the prescribed time for the contribution periods from April to August 2010. The defendant was fined $3,000 for the first two summonses and $4,000 for each of the remaining three summonses, totalling $18,000.
