Contractor fined for violation of safety rules

     Tao Kee Engineering Company Limited was fined $25,000 at Tuen Mun Magistrates' Court today (October 7) for violation of the Factories and Industrial Undertakings Ordinance and the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations.  The prosecution was launched by the Labour Department.

     The case involved a fatal accident that occurred on November 10 last year on a construction site in Tuen Mun.  While a bundle of steel bars was being lifted by a crane, one of the steel bars fell and hit a worker who subsequently died.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, a proprietor must provide and maintain a system of work that is, so far as is reasonably practicable, safe and without risks to the health of the persons employed.  Any proprietor who fails to do so is liable to a maximum fine of $500,000.

     In addition, according to Regulation 7J(1)(b) of the Factories and Industrial Undertakings (Lifting Appliances and Lifting Gear) Regulations, the owner of a lifting appliance shall ensure that every part of the load to be raised or lowered by the lifting appliance is adequately secured.  Any owner who fails to do so is liable to a maximum fine of $200,000.
