Broadcasting Authority's deliberations in September

The following is issued on behalf of the Broadcasting Authority:

It is an update reflecting the outcome of the Broadcasting Authority's deliberations in September 2010.

     At its meeting in September 2010, the Broadcasting Authority (BA) considered two cases in respect of licensees' compliance with the codes of practices on programme and advertising standards¡V

(a) Four public complaints against the television programme "Seed of Chucky" broadcast on the World Channel of Asia Television Limited (ATV) on June 7, 2010.  The BA decided that ATV should be warned to observe more closely the relevant provisions in the Generic Code of Practice on Television Programme Standards (TV Programme Code).

(b) Eight public complaints against the third to sixth episodes of the radio programme "Night Rider 18" broadcast on CR1 and CR2 Channels of Hong Kong Commercial Broadcasting Company Limited (CR) on May 15, 22, 29 and June 5, 2010.  The BA considered that the complaints were in essence the same as those against the first two episodes of the programme for which sanctions had already been imposed on CR, and decided that no further sanction should be imposed.

     The BA also noted that in August 2010, the Commissioner for Television and Entertainment Licensing (CTEL) dealt with 128 cases (175 complaints) under its delegated authority, of which two cases (three complaints) were classified as minor breaches and 88 cases (119 complaints) were unsubstantiated.  The remaining 38 cases (53 complaints) were held to be outside the ambit of the Broadcasting Authority Ordinance. The monthly complaints figures dealt with by CTEL from August 2009 to August 2010 are shown in Figure 1.  A chart showing the respective nature of the unsubstantiated complaints classified by CTEL in August 2010 is at Figure 2.  Three complaints about inaccurate and misleading factual material were classified as minor breaches in the month.  Please visit the BA website (www.hkba.hk) for further information of the complaints.
