The Annual Report of the Independent Commission Against Corruption (ICAC) Complaints Committee for 2009 was tabled in the Legislative Council today (July 7). This is the 15th annual report published by the committee to account for its work in the year.
The committee is responsible for monitoring the handling of non-criminal complaints against the ICAC and its officers. The committee carefully examines the findings of investigations into these complaints and renders independent advice. It also reviews the ICAC's procedures, guidelines and practices found to be conducive to complaints and makes recommendations for improvement.
In 2009, the committee received 31 complaints comprising 90 allegations against the ICAC and its officers. Among these allegations, 49% were related to misconduct by ICAC officers, 38% neglect of duties by ICAC officers and 13% abuse of power.
During the year, the committee held three meetings to consider papers and reports on 20 complaints comprising 53 allegations. Four allegations in two complaints were found to be substantiated. The relevant ICAC officers were given a verbal warning and appropriate advice.
In the course of examination, the committee scrutinised the internal procedures, guidelines and practices of the ICAC. On the recommendation of the committee, the ICAC has put in place various improvement measures.
In 2009, the committee was chaired by Mr Andrew Liao Cheung-sing. Other members were Mr Anthony Chan Kin-keung, Miss Anna Chow Suk-han, Mr Albert Ho Chun-yan, Mrs Stella Lau Kun Lai-kuen, Mrs Sophie Leung Lau Yau-fun, Dr Edward Leong Che-hung, and the representative of The Ombudsman, Mr Tony Ma.
