Convictions of making false statements to claim MPF benefits

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Two scheme members of Mandatory Provident Fund (MPF) Scheme were convicted today (June 15) and fined $13,000 at the Kwun Tong Magistracy for breaching section 43E(1) of the Mandatory Provident Fund Schemes Ordinance (the Ordinance) by making false and misleading statements submitted in documents to the approved MPF trustees.

     The defendant, Lee Yuet-fong, was charged with the offence under Section 43E(1) of the Ordinance for making false and misleading statement to the trustee and was fined $6,000.

     The defendant, Ng Ho-fai, was charged with the offence under Section 43E(1) of the Ordinance for making false and misleading statement to the trustee and was fined $7,000.

     According to the prosecution, the defendants applied to their trustees on October 8, 2009 and November 23, 2009 respectively for early withdrawal of their MPF accrued benefits on the ground of permanent departure. Investigation by the Mandatory Provident Fund Authority (MPFA) found that the two defendants had recklessly provided false and misleading statements in claiming that they had not previously claimed payment of accrued benefits on the ground of permanent departure on an earlier departure date.

     Meanwhile, an officer and four employers were fined $169,000 at the Kwun Tong Magistracy today after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Chan Hoi-lam, officer of Vevion Hong Kong Limited (BR no.: 34562286), was charged for offences under section 7A(8) and section 44 of the Ordinance, pleading guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between August and December 2009. The defendant was fined $5,000 for each summons, totalling $25,000.

     Vevion Hong Kong Limited was also charged for an offence under section 7A(8) of the Ordinance. The defendant pleaded guilty to five counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between August and December 2009. The defendant was fined $5,000 for each summons, totalling $25,000.

     Alfa House Company Limited (BR no.: 21659236) pleaded guilty to an offence under section 7(1) of the Ordinance. The defendant was fined $6,000 for the summons for failing to enroll an employee in MPF scheme as required by the Ordinance.

     Alfa House Company Limited was also charged for an offence under section 7AA(7) of the Ordinance. The defendant pleaded guilty to 12 counts of failing to make MPF contributions for its relevant employee who was not a member of registered scheme within the prescribed time for the contribution periods between November 2008 and October 2009. The defendant was fined $3,000 for each summons, totalling $36,000.

     Chan Luk Kee Restaurant Limited (BR no.: 37406568) was charged for an offence under section 7A(8) of the Ordinance. The defendant pleaded guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between July and September 2008. The defendant was fined $2,000 for each summons, totalling $6,000.

     Global Mag & Press (HK) Limited (BR no.: 32100820) was charged for an offence under section 7A(8) of the Ordinance. The defendant pleaded guilty to 30 counts of failing to make MPF contributions for two employees within the prescribed time for the contribution periods between April 2007 and September 2009. The defendant was fined $71,000 in total.

     The MPFA today also obtained an order for payment of outstanding MPF contributions at about $177,000 against an employer in the District Court.

     The District Court today issued judgments against an employer, Noble Logistics (Worldwide) Limited. The defendant was ordered to pay the MPFA the sum of $177,013.84, being mandatory contributions in arrears and surcharges payable to 17 employees of the defendants respectively.

     The amounts awarded at the District Court will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to pay the cost of $930.
