Proprietor fined for violation of safety rules

     Top Vim Company Limited was fined $70,000 at Fanling Magistrates' Court today (March 16) for violation of the Factories and Industrial Undertakings Ordinance and the Factories and Industrial Undertakings (Electricity) Regulations.  The prosecutions were launched by the Labour Department.

     The case involved a fatal accident occurred on August 14 last year in a workplace at Sheung Shui.  A male worker was electrocuted while conducting electric arc-welding inside the concrete mixing drum of a concrete mixer truck.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, the proprietor must provide a system of work that is, so far as is reasonably practicable, safe and without risks to health of the persons employed.  Any proprietor who fails to do so is liable to a fine of $500,000.

     In addition, according to Regulation 5(1) of the Factories and Industrial Undertakings (Electricity) Regulations, all apparatus and conductors shall be constructed, installed, protected and maintained so as to prevent electrical hazard.  Any proprietor who fails to do so is liable to a fine of $50,000.
