The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (March 10) obtained an order for payment in the High Court against an employer for outstanding MPF contributions of about $2.8 million.
The High Court issued a judgment against Gainway Cleaning Limited. The defendant was ordered to pay the MPFA $2,884,515.52, being mandatory contributions in arrears and surcharges payable to employees of the defendant.
The MPFA also pursued five claims in the Small Claims Tribunal for about $146,000 on behalf of 13 employees, who were owed MPF contributions by their employers.
At the tribunal's hearing today, Surplus Come Catering Consultancy Services Limited, did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $14,132.5, being mandatory contributions in arrears and surcharges payable.
Aztec International Company Limited, Billion Base Industries Limited, Best Billion Limited and Sun Bright International Enterprise Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $47,028.57, $42,458.18, $31,743.81 and $11,362.34, being mandatory contributions in arrears and surcharges payable.
The amounts both awarded at the High Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The High Court ordered the defendant to pay costs of $1,645. The tribunal ordered the respective defendants to pay costs of $158, $170, $225, $205 and $135.
