Amendments to draft Clear Water Bay Peninsula North OZP proposed

     The Town Planning Board today (January 29) announced proposed amendments to the draft Clear Water Bay Peninsula North Outline Zoning Plan (OZP).  

     The draft Clear Water Bay Peninsula North OZP No. S/SK-CWBN/1 was exhibited on March 18, 2005, for public inspection under section 5 of the pre-amended Town Planning Ordinance (pre-amended Ordinance).  After preliminary and further considerations, the Board decided not to propose any amendment to the draft OZP to meet the objections.

     The draft OZP was subsequently approved by the Chief Executive in Council under section 9(1)(a) of the pre-amended Ordinance and renumbered S/SK-CWBN/3.  

     An objector lodged a judicial review of the Board's decision not to propose amendment to the draft OZP No. S/SK-CWBN/1 to meet his objection in February 2006. A judicial review of the Chief Executive in Council's decision to approve the OZP was lodged in January 2007.

     On November 6, 2007, the Court of First Instance granted an order of certiorari to bring up and quash the decision of the Board not to amend the draft OZP to meet the objection, and a similar order of certiorari to bring up and quash the decision of the Chief Executive in Council to approve the draft OZP insofar as they related to the three objection sites concerned. The Court also ordered that the objection to the three sites be remitted to the Board for reconsideration.  

     On July 31, 2009, the Board reconsidered the objection under section 6(6) of the pre-amended Ordinance, and proposed amendments to the draft Clear Water Bay Peninsula North OZP No. S/SK-CWBN/1 to partially meet the objection.  

     On December 11, 2009, the Board agreed that the proposed amendments be notified under section 6(7) of the pre-amended Ordinance.

     The proposed amendments mainly involve the rezoning of an area between Clear Water Bay Road and Pik Shui Sun Tsuen from "Conservation Area" to "Government, Institution or Community (5)", primarily for the provision of hospital facilities, and the rezoning of another area between University Road and Staff Quarters of Hong Kong University of Science and Technology from "Conservation Area" to "Government, Institution or Community (6)", primarily for the provision of hospital staff quarters.

     Amendments have also been made to the Notes of the Plan.  They include the incorporation of Notes for the new "Government, Institution or Community (5)" and "Government, Institution or Community (6)" zones.

     The Amendment Plan No. O/S/SK-CWBN/1-A1 and the proposed amendments to the Notes and Explanatory Statement are now available for public inspection from today (January 29) to February 12 during office hours at the secretariat of the Board, the Planning Enquiry Counters in the North Point and Sha Tin Government Offices, the Sai Kung and Islands District Planning Office, the Sai Kung District Office and the Hang Hau Rural Committee.

     Between January 29 to February 12, 2010, any person can submit written objection to the proposed amendments to the secretary of the Board.

     Copies of the draft Clear Water Bay Peninsula North OZP No. S/SK-CWBN/1 together with the Amendment Plan No. O/S/SK-CWBN/1-A1 are available for sale at the Map Publications Centres in North Point and Yau Ma Tei.  The electronic version of the plan can be viewed at the Board's website (www.info.gov.hk/tpb).
