Contractor and proprietor fined for violation of safety rules

     Kinson Engineering Ltd and Dick's Design Engineering Co. were fined a total of $35,500 at Tsuen Wan Magistrates' Court today (October 28) for violation of the Factories and Industrial Undertakings Ordinance and the Construction Sites (Safety) Regulations. The prosecutions were launched by the Labour Department.

     The case involved a fatal accident on August 4 last year on a construction site at Tsuen Wan when a worker was electrocuted.

     According to Section 6A(2)(a) of the Factories and Industrial Undertakings Ordinance, proprietors must provide and maintain a safe system of work that is, so far as is reasonably practicable, safe and without risks to health of the employees.  Any proprietor who fails to do so is liable to a fine of $500,000 and to imprisonment for six months.

     In addition, according to Regulations 47(1) and 47(1A) of the Construction Sites (Safety) Regulations, contractors must take measures to prevent workmen from being endangered by live electric cables. Any contractor who fails to do so is liable to a fine of $200,000.
