13 employers ordered to pay MPF arrears

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (September 4) obtained eight orders for payment of outstanding MPF contributions at about $1,282,000 against eight employers in the District Court. Meanwhile, the MPFA pursued five claims in the Small Claims Tribunal for some $48,000 on behalf of seven employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against eight employers, namely, Forever Printing Company Limited, Legendfield Limited trading as Wong Shing Seafood Hot Pot Restaurant, Namwing Food And Beverage Company Limited trading as Shun Tin Restaurant, Joint Well Management Limited, Painting International Beauty Limited, Mega Projects Constructions Limited, Rever Innovation Salon Limited and Newco Enterprises Limited. The defendants were ordered to pay the MPFA the sum of $285,533.23, $239,501.32, $204,545.99, $186,560, $148,107.01, $82,274.5, $79,925.67 and $56,111.06 respectively, being mandatory contributions in arrears and surcharges payable to 4, 44, 48, 18, 17, 10, 12 and 2 employees of the defendants.

     Meanwhile, at the Tribunal's hearing today, two defendants, namely East union Construction Limited and Spi Marketing Limited, did not dispute the amounts claimed. The Adjudicator ordered them to pay the MPFA the sums of $5,016.38 and $4,165, being mandatory contributions in arrears and surcharges payable.

     Also, three defendants, namely Ocean China Transportation Ltd, Chan Ka Man trading as Akina Auto Centre and Shining Star Restaurant (Tai Kok Tsui) Limited, did not appear at the hearing today. In their absence, the Adjudicator ordered them to pay the MPFA the sums of $15,474.25, $13,117.13 and $11,156.24,being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the Tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to pay costs of $930. The Tribunal ordered the respective defendants to pay $119, $96, $90, $190 and $110 as the costs in respect of the claims.

     Ocean China Transportation Ltd pleaded guilty previously at Kwun Tong Magistracy to a count of failing to enroll its employee in an MPF scheme as required by the Ordinance and was fined $10,000.
