Employer ordered to pay MPF non-payment

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (July 15) pursued a claim in the Small Claims Tribunal for about $10,000 on behalf of 25 employees, who were owed MPF contributions by their employer and also pursued a claim for a $5,000 financial penalty against an employer who failed to make MPF contributions for employees.

     Good Huge Limited trading as Sunrise Seafood Restaurant and Business & Industrial Trade Fairs Ltd, did not appear at today's tribunal hearing. In their absence, the Adjudicator ordered Good Huge Limited trading as Sunrise Seafood Restaurant to pay the MPFA $10,209.60, being mandatory contributions in arrears and surcharges payable. The Adjudicator also ordered Business & Industrial Trade Fairs Ltd to pay the MPFA $5,000 which was a financial penalty imposed by the MPFA for failure to make MPF contributions for employees.

     The amounts awarded will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $196.40 and $215.

     Business & Industrial Trade Fairs Ltd was previously fined $20,000 on seven counts of failing to make MPF contributions on time.
