One officer and three employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     One officer and three employers were fined a total of $21,700 at the Kwun Tong Magistracy today (July 14), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance.

     David Yau Chun Kit, an officer of Degreeasia Limited trading as Hong Kong Institute Continuing Education, was charged for offences under section 7A(8) and section 44 of the ordinance. The defendant pleaded guilty to seven counts of failing to make MPF contributions for its employee within the prescribed time for the contribution period between August 2008 and February 2009. The defendant was fined $1,000 for each summons, totalling $7,000.

     Degreeasia Limited trading as Hong Kong Institute Continuing Education was also charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to seven counts of failing to make MPF contributions for its employee within the prescribed time for the contribution periods between August 2008 and February 2009. The defendant was fined $1,000 for each summons, totalling $7,000.

     AMP Holdings Limited was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to four counts of failing to make MPF contributions for its employees within the prescribed time for the contribution periods between November 2008 and January 2009.  The defendant was fined $1,800 for each summons, totalling $7,200.

     Sport Field Limited was charged for an offence under section 7A(8) of the ordinance. The defendant pleaded guilty to a count of failing to make MPF contributions for its employee within the prescribed time for the contribution periods in March 2008. The defendant was fined $500 for the summons.

     Moreover, the MPFA today pursued six claims in the Small Claims Tribunal for some $196,000 on behalf of 35 employees, who were owed MPF contributions by their employers.

     At the tribunal's hearing today, the six defendants, namely Healing Hands Limited, New Generation Travel Limited, Venezia Environment Services Limited, Quicksenda Company Limited, 668 Investment Limited trading as Florence and AMP Holdings Limited, did not appear. In their absence, the adjudicator ordered them to pay the MPFA the sums of $47,573.84, $46,085.08, $42,435.47, $36,921.94, $14,000 and $9,701.12,being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal ordered the defendants to pay $245, $180, $160, $180, $89 and $89 as the costs in respect of the claims.
