Seven employers ordered to pay MPF non-payments

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     The Mandatory Provident Fund Schemes Authority (MPFA) today (June 23) obtained two orders in the District Court against two employers for payment of outstanding MPF contributions at about $220,000. The MPFA also pursued five claims in the Small Claims Tribunal for about $34,000 on behalf of 19 employees, who were owed MPF contributions by their employers.

     The District Court today issued judgments against Kwok Chi Kwong trading As Chung Kee Transportation Company and Slim Fortress Development Asia Limited trading as Slim Fortress. The defendants were ordered to pay the MPFA $122,637.48 and $101,307.07 respectively, being mandatory contributions in arrears and surcharges payable to six and 15 employees of the defendants.

     At the tribunal's hearing, Golden Power Transportation Limited did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $9,902.55, being mandatory contributions in arrears and surcharges payable.

     The other four defendants, China-HK Canteen Limited, Areca Technologies (HK) Pte Limited, Ocean Sky Enterprise Limited and Matteo Trading Limited trading as Arctic Ocean Food Company, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $16,665, $4,027.20, $2,987.08 and $670.40, being mandatory contributions in arrears and surcharges payable.

     The amounts both awarded at the District Court and the tribunal will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The District Court ordered the defendants to each to pay costs of $930. The tribunal ordered the respective defendants to pay costs of $345, $246, $106, $156 and $135.
