Five employers fined for breaching MPFS Ordinance

The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:

     Five employers were fined $60,500 at the Kwun Tong Magistracy today (May 4), after being convicted of offences under the Mandatory Provident Fund Schemes Ordinance (Cap. 485).

     Plenty Profit Holdings Limited trading as Lucky Fellow Restaurant was with charged under section 43E(1) of the ordinance  with making a false or misleading statement. The defendant pleaded guilty to misreporting the departure date of an employee to trustee, and was fined $7,000.

     The defendant was also charged under section 7A(8) of the ordinance, pleading guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between April and June 2008. The defendant was fined a total of $12,000.

     Wing Ho Investments Limited trading as Chin Wah Restaurant was charged for an offence under section 7A(8), pleading guilty to three counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between May and July 2008. The defendant was fined a total of $3,000.

     Ma Ting Chiu trading as VIP Management Company was charged for an offence under section 7A(8), pleading guilty to 17 counts of failing to make MPF contributions for an employee within the prescribed time for the contribution periods between March 2006 and July 2007. The defendant was fined a total of $25,500.

     Ocean China Transportation Limited pleaded guilty under section 7(1) of the ordinance and was fined $10,000 for failing to enrol an employee in an MPF scheme.

     Shum Kwok Yan trading as Sky Transportation Co pleaded guilty under section 7(1) of the ordinance and was fined $3,000 for failing to enrol an employee in an MPF scheme.

     The MPFA today also pursued 10 claims in the Small Claims Tribunal for about $180,000 on behalf of 63 employees, who were owed MPF contributions by their employers.

     Tsoi Mau Hung, Kong Kwok On & Fong Chun Hing trading as Wing Lun Construction Engineering Co, Brilliant Education Group Limited trading as Brilliant Learning Centre, Kan Hing Manufacturing Limited, Petworld Enterprises Limited, Man Kwong Lighting Limited, Rhoda International Kindergarten, Javed Iqbal and Khan Azhar trading as World Telelinks, Ng Chi Hung formerly trading as To To Restaurant, Jet Wise Industries Limited and Cheung Kee Stoneworks Limited, did not appear. In their absence, the Adjudicator ordered them to pay the MPFA $46,919.40, $36,120.44, $31,116.06, $26,477.69, $22,263, $9,262.10, $7,560, $5,577.20, $1,466.59 and $259.88, being mandatory contributions in arrears and surcharges payable.

     The amounts awarded at the tribunal will be reimbursed to the employees¡¦ MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $249, $170, $165, $136, $212, $80, $180, $160, $102 and $115.
