The following is issued on behalf of the Mandatory Provident Fund Schemes Authority:
The Mandatory Provident Fund Schemes Authority (MPFA) today (April 28) pursued six claims in the Small Claims Tribunal for about $110,000 on behalf of 40 employees, who were owed MPF contributions by their employers.
Defendant Lam Siu Wai, formerly known as Lam Siu Kwong formerly trading as Tat Lee Engineering did not dispute the amount claimed. The Adjudicator ordered it to pay the MPFA $11,307.47, being mandatory contributions in arrears and surcharges payable.
The other five defendants, Brilliant Education Group Limited trading as Brilliant Learning Centre, 8Company Limited, Law Chun Hing and Yue Fat Kun trading as Wan Kau Metal Engineering Co, Stephen Finley trading as Finley & Co. and Wah Tai Farm Company Limited, did not appear at today's hearing. In their absence, the Adjudicator ordered them to pay the MPFA $46,559.27, $24,042.51, $12,600, $11,107.98 and $4,260.28, being mandatory contributions in arrears and surcharges payable.
The amounts awarded will be reimbursed to the employees' MPF accounts as soon as they are received by the MPFA. The tribunal further ordered the respective defendants to pay costs of $145, $240, $196, $180, $170 and $90.
Wah Tai Farm Company Limited was previously convicted on four counts of failing to make MPF contributions on time and was fined $10,500.
